Operated by Nicole Hart Studio (“we,” “us,” or “our”) which is a subset of Supernova Creative Inc.

By purchasing or participating in the Portrait Club membership (“Membership” or “Club”), you agree to the following Terms of Service.

1. Membership Overview

The Portrait Club is a month-to-month membership program that provides access to live classes, recorded sessions, educational materials, creative challenges, community spaces, and related resources (collectively, the “Services”).

There is no minimum commitment. Your Membership continues on a monthly basis until cancelled.

We reserve the right to modify, update, or improve the Services at any time.

2. Billing & Automatic Renewal

• Membership fees are billed monthly on a recurring basis.

• By enrolling, you authorize Nicole Hart Studio to automatically charge your selected payment method each month on your billing date.

• Membership automatically renews unless cancelled prior to your next billing date.

• Prices are listed in USD and applicable taxes may be added where required by law.

Failure to process payment may result in suspension or termination of access.

3. Cancellation Policy

You may cancel your Membership at any time.

To cancel:

• Email nicole.catherine.hart@gmail.com before your next billing date.

Cancellation takes effect at the end of your current billing period. You will retain access until that period expires. No partial-month refunds or credits will be issued.

If you cancel after your billing date, your Membership will remain active for that paid month and will not renew thereafter.

4. Refund Policy

Because the Portrait Club provides immediate access to digital content and live programming:

• Refunds are available within 48 hours, provided you have not substantially accessed the Services.

• After this initial period, all Membership fees are non-refundable.

• No refunds or credits are provided for:

  • Partial months

  • Missed live sessions

  • Failure to attend or participate

  • Forgotten cancellations after renewal

Refund requests must be submitted in writing to [insert email].

5. Live Sessions & Availability

Live sessions may be recorded and made available for replay at our discretion.

We reserve the right to:

• Reschedule live sessions

• Substitute instructors or content

• Modify programming as needed

No refunds or credits are provided for missed sessions or scheduling changes.

6. No Guarantees

The Portrait Club is an educational and creative program. We do not guarantee specific artistic results, business growth, income increases, or personal outcomes.

Your results depend on your own effort, skill, and participation.

Participation in the Club does not create a client-photographer relationship unless separately contracted.

7. Community Conduct

Members agree to maintain respectful and professional behavior in all Club spaces, including live sessions and community groups.

The following are prohibited:

• Harassment or discrimination

• Hate speech

• Spamming or unauthorized promotion

• Sharing other members’ work without permission

• Disruptive or harmful conduct

We reserve the right to suspend or terminate Membership without refund for violations of this section.

8. Intellectual Property

All materials provided within the Portrait Club — including videos, recordings, PDFs, guides, curriculum, graphics, and branding — are the intellectual property of Nicole Hart Studio.

Membership grants you a limited, non-transferable, non-exclusive license for personal, non-commercial use only.

You may not:

• Share login access

• Reproduce or redistribute materials

• Record or republish live sessions

• Sell or repurpose Club content

Unauthorized use may result in termination and legal action.

9. Use of Photos, Recordings & Marketing

By participating in the Portrait Club, you grant Nicole Hart Studio a non-exclusive, royalty-free, worldwide, perpetual license to use:

• Photos you submit within the Club

• Artwork shared during sessions

• Screenshots or recordings of live classes

• Testimonials, comments, or feedback

• Your name and likeness as captured during participation

These materials may be used for promotional and marketing purposes, including website content, social media, advertising, and email communications.

If you prefer not to have your likeness or work used for marketing, you must notify us in writing at nicole.catherine.hart@gmail.com, We will make reasonable efforts to honor your request moving forward.

This license survives termination of Membership.

10. Privacy

Your personal information is handled in accordance with our Privacy Policy, available at www.nicolehartstudio.com/privacy

By joining the Membership, you consent to the collection and use of your information as outlined therein.

11. Chargebacks & Payment Disputes

Members agree to contact Nicole Hart Studio directly to resolve billing issues prior to initiating a chargeback or payment dispute.

Initiating an unwarranted chargeback may result in immediate termination of Membership access.

12. Termination

We reserve the right to suspend or terminate access to the Membership at our discretion if these Terms are violated.

Upon termination, access to all Services will cease immediately.

13. Force Majeure

We are not responsible for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to illness, technical issues, internet outages, government restrictions, or natural disasters.

14. Governing Law

These Terms are governed by the laws of Canada and the applicable laws of the Province of Nova Scotia without regard to conflict of law principles.

Any disputes shall be resolved in the courts of that Province.

15. Changes to These Terms

We may update these Terms at any time. Updated Terms will be posted on our website with a revised effective date.

Continued participation in the Membership constitutes acceptance of the updated Terms.
